What this compute may not be used for
This policy applies to all use of Nachster AI compute — the managed API, private endpoints and dedicated clusters. Where it conflicts with your agreement, the agreement prevails.
1. Prohibited uses
The compute may not be used to:
- break the law, or to facilitate breaking it.
- develop biological, chemical, nuclear or radiological weapons, or their delivery systems.
- attack critical infrastructure, create or distribute malware, or intrude into systems without authorisation.
- generate, obtain or distribute child sexual abuse material.
- impersonate a real person, or generate sexual depictions of a real person without their consent.
- conduct surveillance without consent, track individuals at scale using biometrics, or operate social credit scoring.
- generate or distribute mass disinformation for fraud, impersonation or election interference.
- infringe third-party intellectual property rights.
2. Export control and compliance
You will comply with Japan's Foreign Exchange and Foreign Trade Act and any other applicable export control legislation. We procure and own the accelerators ourselves and are the end user of the hardware we deploy; what you acquire is a service, and you take no ownership, possession or custody responsibility for a controlled item.
Before contracting we perform know-your-customer checks on you and your beneficial owners. We do not contract with sanctioned parties or with parties of concern under export control.
3. The scope of monitoring
What we monitor differs by tier. We will not describe it as though it were uniform.
- Dedicated clusters and private endpoints — single-tenant hardware
- Compliance monitoring is metadata-level only: the identity of the connecting party, origin region, usage volume and anomalous patterns. We do not inspect prompts, completions or training data.
- Managed API — a shared service
- In addition to the above, automated abuse filtering runs. This is necessary to protect shared infrastructure and the other customers on it.
4. If this policy is breached
Where a breach is identified we may, depending on the circumstances, require remediation, suspend the workload, or suspend the service. Except where the matter is urgent and serious, we notify your designated contact before suspension and give you an opportunity to remediate. Where we are under a legal reporting obligation, we comply with it.
